By downloading, accessing, or using the Passage application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Max Apps ("Company", "we", "us", "our").
You must be at least 13 years of age to create an account and use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By creating an account, you represent and warrant that you meet these eligibility requirements.
To use certain features of the App, you must create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or its content.
You retain ownership of the content you post on Passage ("User Content"), including book passage photographs, highlighted text, comments, and profile information. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing the App.
You represent and warrant that you own or have the necessary rights and permissions to post your User Content, and that your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.
You agree not to:
- Post content that is objectionable, offensive, hateful, discriminatory, sexually explicit, violent, threatening, or illegal
- Harass, bully, threaten, intimidate, or abuse other users
- Share content that infringes upon intellectual property rights or copyright
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Use the App for spam, phishing, scams, or unauthorized commercial purposes
- Attempt to circumvent any security features of the App
- Use automated systems, bots, or scripts to access the App
- Collect or harvest user data without authorization
We reserve the right, but are not obligated, to monitor, review, and remove User Content at our sole discretion. We have zero tolerance for objectionable content or abusive behavior. Violations of these Terms may result in immediate content removal and permanent account termination without prior notice.
Users may report objectionable content or abusive users using the reporting features available throughout the App. We review all reports and take appropriate action.
We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time through the App's Settings. Upon termination, your right to use the App ceases immediately, and we may delete your User Content.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
To the maximum extent permitted by applicable law, Max Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.
